Our website and online store are hosted through Squarespace. Squarespace provides the website and ecommerce platform that enables us to display and sell our products online. Your purchase is made with Claymilkdad, not with Squarespace.
By accessing our website, browsing our store or purchasing a product from us, you agree to these Terms of Service (“Terms”), together with any other policies referenced on our website, including our Refund & Returns Policy and Privacy Policy.
Please read these Terms carefully before using our website or purchasing from us. If you do not agree with these Terms, please do not use our website or purchase our products.
We may update these Terms from time to time by publishing an updated version on our website. Any changes will apply from the date they are published, unless otherwise required by law.
SECTION 1 — ONLINE STORE TERMS
By using our website or purchasing from us, you confirm that you are legally capable of entering into a contract under applicable Australian law.
If you are under 18, you should only make a purchase with the involvement and consent of a parent or legal guardian.
You must not use our website or products for any unlawful or unauthorised purpose, or in a way that breaches any applicable law.
You must not introduce viruses, malware or other harmful code to our website or systems.
We reserve the right to refuse or cancel an order where permitted by law, including where we reasonably believe an order has been placed fraudulently, unlawfully or in breach of these Terms.
SECTION 2 — GENERAL CONDITIONS
We reserve the right to refuse service or cancel an order where permitted by law.
You agree not to reproduce, duplicate, copy, sell, resell or commercially exploit any part of our website, product designs, photographs, written content, branding or other materials without our prior written permission, except where permitted by law.
The headings used in these Terms are included for convenience and do not affect the meaning of the Terms.
Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies that cannot legally be excluded, restricted or modified under Australian law.
SECTION 3 — HANDMADE CERAMICS AND PRODUCT VARIATIONS
Claymilkdad products are handmade and may contain natural variations in colour, glaze, texture, shape, size and finish.
Small variations, marks, speckles, glaze differences, pinholes, minor surface variations or other characteristics may occur as a result of the handmade ceramic-making process. These characteristics may be part of the individual nature of a handmade product and are not necessarily defects.
Each handmade piece may differ slightly from product photographs or other pieces of the same design.
Product photographs are intended to provide a reasonable representation of each product. Colours may appear differently depending on your screen, device, lighting and other factors.
Where dimensions are provided, they are approximate.
We aim to accurately describe our products and disclose any known significant imperfections or characteristics that may affect their use.
Nothing in this section limits your rights under the Australian Consumer Law.
SECTION 4 — PRODUCT CARE AND USE
You are responsible for using and caring for your Claymilkdad products in accordance with any care instructions provided with the product or on our website.
Ceramic products can be fragile and may break if dropped, knocked or otherwise mishandled.
Unless we specifically state otherwise in the individual product description or care instructions, you should not assume that a ceramic item is suitable for:
use in a dishwasher;
use in a microwave;
use in an oven;
use with food or beverages; or
prolonged exposure to extreme temperatures.
Where a product is specifically described as suitable for a particular use, please follow the care and use instructions provided with that product.
Damage caused by misuse, accidental breakage, improper care or use contrary to our instructions may not be covered by our change-of-mind returns policy. This does not affect your rights under the Australian Consumer Law.
SECTION 5 — CERAMIC MAGNETS AND ACCESSORIES
Some Claymilkdad products, including ceramic magnets, contain magnets or other small components.
Claymilkdad ceramic magnets are intended for adult use and are decorative and/or functional household accessories. They are not designed or marketed as children's toys.
Keep ceramic magnets and other small components away from young children and pets, as small components may present a choking or other safety hazard if swallowed.
If a ceramic magnet becomes cracked, broken, loose or damaged, discontinue use.
Magnets may interfere with certain medical devices or electronic equipment. If you use a medical device that may be affected by magnets, follow the advice of your healthcare professional or the device manufacturer.
You are responsible for using our products appropriately and in accordance with any care or safety instructions provided.
Nothing in this section limits any rights you have under the Australian Consumer Law.
SECTION 6 — PRODUCTS, PRICES AND AVAILABILITY
We reserve the right to change product prices, descriptions and availability at any time.
All prices are displayed in Australian dollars (AUD) unless otherwise stated.
Where applicable, prices will include GST.
Because many Claymilkdad products are handmade and produced in limited quantities, some products may have limited availability.
If a product becomes unavailable after you have placed an order, we will contact you and, where appropriate, offer an alternative or refund the affected amount.
We may discontinue products at any time.
We reserve the right to limit quantities purchased where reasonably necessary, including where we suspect an order is being placed for resale or commercial distribution without our permission.
Nothing in this section affects your rights under the Australian Consumer Law.
SECTION 7 — ORDERS AND PAYMENT
When you place an order through our website, you are making an offer to purchase the products selected in your order.
An order is accepted when we confirm the order or otherwise indicate that the purchase has been accepted.
We reserve the right to decline or cancel an order where permitted by law, including where:
a product is unavailable;
there has been an obvious pricing or listing error;
we reasonably suspect fraud or unauthorised activity;
payment cannot be processed; or
the order would breach these Terms or applicable law.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order.
You are responsible for providing accurate billing, shipping and contact information.
You agree to promptly update your information if it changes so that we can process your order and contact you where necessary.
SECTION 8 — SHIPPING AND DELIVERY
Shipping options, costs and estimated delivery timeframes will be displayed on our website or during checkout.
Delivery timeframes are estimates unless we expressly state that a particular delivery date is guaranteed.
Because our products are handmade, processing times may vary. Where a specific processing or dispatch timeframe is stated on a product page or at checkout, that timeframe will apply.
Once an order has been dispatched, delivery may be affected by postal services, courier delays, public holidays, weather, incorrect delivery information or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address.
If your order arrives damaged, is missing or appears to have been lost in transit, please contact us at claymilkdad@gmail.com as soon as reasonably possible.
Where an item arrives damaged, please retain the packaging and, where possible, provide photographs of the damaged product and packaging so that we can investigate the issue.
Nothing in this section limits your rights under the Australian Consumer Law.
SECTION 9 — RETURNS, REFUNDS AND CONSUMER GUARANTEES
Our returns and refund procedures are set out in our Refund & Returns Policy.
Refund & Returns Policy: https://claymilkdad.com/shipping-returns
Our Refund & Returns Policy operates alongside and does not replace your rights under the Australian Consumer Law.
Our products come with consumer guarantees that cannot be excluded under Australian law.
Depending on the circumstances, if a product has a problem covered by a consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy.
A change-of-mind return is different from a product that is faulty or does not meet the consumer guarantees.
Unless otherwise stated in our Refund & Returns Policy, we are not required to provide a refund, replacement or exchange simply because you have changed your mind, do not like the product or no longer want it.
However, this does not affect any rights you have under the Australian Consumer Law.
Australian Consumer Law Notice
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You may also be entitled to have goods repaired or replaced where they fail to meet a consumer guarantee and the failure does not amount to a major failure.
SECTION 10 — INTELLECTUAL PROPERTY
Unless otherwise stated, all content on the Claymilkdad website, including our name, branding, logos, product photographs, product designs, graphics, written content and other materials, is owned by or licensed to Claymilkdad.
You must not reproduce, copy, modify, distribute, publish, sell or commercially exploit our content without our prior written permission, except where permitted by law.
You may view and use our website for your personal and lawful purposes.
Purchasing a Claymilkdad product does not give you ownership of our intellectual property or permission to reproduce our designs commercially.
SECTION 11 — USER CONTENT, REVIEWS AND FEEDBACK
If you send us comments, feedback, reviews, photographs, suggestions, ideas or other material (“Submissions”), you confirm that you have the right to provide that material to us.
You must not submit content that:
infringes another person's intellectual property or other rights;
is unlawful, threatening, defamatory, abusive, obscene or misleading;
contains malicious software or harmful code;
impersonates another person; or
breaches any applicable law.
If you submit a review, photograph or other content to us for potential publication, you grant Claymilkdad a non-exclusive, royalty-free licence to use, reproduce and display that content for the purposes of operating and promoting Claymilkdad.
You remain responsible for the content you submit.
We may choose not to publish or may remove content that we reasonably consider inappropriate, unlawful, misleading or inconsistent with these Terms.

SECTION 16 — WEBSITE AVAILABILITY AND LIABILITY
We aim to keep our website available and functioning properly, but we cannot guarantee that the website will always be uninterrupted, secure, available or error-free.
Our website may occasionally be unavailable due to maintenance, technical problems, internet disruptions, third-party service interruptions or circumstances outside our reasonable control.
To the maximum extent permitted by law, we are not responsible for loss arising from circumstances outside our reasonable control.

This section does not apply to the extent that the relevant loss was caused by our negligence, unlawful conduct or breach of a non-excludable obligation.
SECTION 18 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be read down or severed to the extent necessary, and the remaining provisions will continue to operate.
The remaining provisions of these Terms will continue in full force and effect.
SECTION 19 — TERMINATION
We may suspend or terminate your access to our website where permitted by law if you materially breach these Terms or use our website unlawfully.
Termination will not affect rights or obligations that arose before termination.
Any provisions that are intended by their nature to continue after termination will continue to apply.
SECTION 20 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund & Returns Policy and any other policies expressly incorporated into these Terms, form the agreement governing your use of our website and purchases from Claymilkdad.
If there is an inconsistency between these Terms and a non-excludable right under Australian law, the applicable law will prevail.
Our failure to enforce a provision of these Terms does not mean that we waive our right to enforce that provision later.
